Terms of Use

These Terms of Use (“Terms”) govern access to and use of the SafeScripts medication incident reporting platform (the “Platform”) operated by SafeScripts Inc. (“SafeScripts”, “we”, “our”, or “us”).

By accessing or using the Platform, you agree to comply with these Terms.

SafeScripts provides software designed to assist community pharmacies in documenting, managing, and analyzing medication incidents and near misses as part of pharmacy quality improvement programs.

The Platform supports pharmacies in meeting professional standards and regulatory expectations established by the Ontario College of Pharmacists, including requirements related to
medication safety and incident documentation.

SafeScripts is intended solely as a documentation and analytics tool and does not replace professional clinical judgment.

The Platform is intended for use only by:
– Licensed community pharmacies
– Pharmacists
– Pharmacy technicians
– Authorized pharmacy staff
– Pharmacy owners or administrators.

Users must comply with all applicable laws, regulations, and professional standards governing pharmacy practice in Canada and Ontario.

Users must create an account to access certain features of the Platform.

Users agree to:
– Provide accurate and current information
– Maintain the confidentiality of login credentials
– Use only their assigned account
– Notify SafeScripts of any unauthorized access.

Users are responsible for all activities conducted under their account.

Users may use the Platform solely for legitimate professional purposes related to medication incident reporting and pharmacy quality assurance.

Users must not:
– Access or attempt to access another pharmacy’s data
– Upload malicious software or attempt to disrupt the Platform
– Use the Platform for unlawful purposes
– Attempt to reverse engineer or compromise the system
– Use the Platform to store unrelated patient data.

SafeScripts reserves the right to suspend or terminate accounts for misuse.

The Platform may process personal health information entered by pharmacies in the course of documenting medication incidents.

Pharmacies are responsible for ensuring that any personal health information entered into the Platform complies with applicable privacy legislation, including the Personal Health Information Protection Act.

Pharmacies act as Health Information Custodians under applicable law. SafeScripts acts as a service provider processing information on behalf of the pharmacy.

SafeScripts encourages users to minimize the inclusion of patient identifiers where possible.

All medication incident data submitted to the Platform remains the property of the submitting pharmacy.

SafeScripts does not claim ownership of pharmacy or patient data.

SafeScripts may generate aggregated or de-identified analytics for medication safety improvement purposes, provided that no individual pharmacy, user, or patient can be identified.

SafeScripts implements administrative, technical, and physical safeguards designed to protect data stored within the Platform.

These safeguards include:
– encrypted data transmission
– secure cloud infrastructure
– access controls
– audit logging

While SafeScripts takes reasonable measures to protect data, no system can guarantee absolute security.

SafeScripts strives to maintain reliable and uninterrupted service.

However, the Platform may be temporarily unavailable due to:
– maintenance
– system updates
– technical issues
– security incidents

SafeScripts does not guarantee uninterrupted access to the Platform.

Pharmacies remain responsible for complying with applicable laws and professional obligations, including requirements established by the Ontario College of Pharmacists.
Use of the Platform does not replace pharmacy responsibilities relating to:
– medication safety
– incident disclosure
– regulatory reporting
– professional conduct

SafeScripts provides the Platform as a software tool to assist pharmacies in documenting and analyzing medication incidents.

To the maximum extent permitted by law, SafeScripts shall not be liable for:
– clinical decisions made by pharmacy professionals
– patient care outcomes
– incomplete or inaccurate data entered by users
– interruptions or technical issues affecting the Platform.

All intellectual property related to the SafeScripts Platform, including software, branding, design, and documentation, is owned by SafeScripts Inc.

Users may not copy, modify, distribute, or reproduce the Platform without written permission.

SafeScripts may suspend or terminate user access if:
– these Terms are violated
– misuse of the Platform is detected
– continued access presents security risks

Users may terminate their use of the Platform at any time by closing their account.

SafeScripts may update these Terms from time to time.

When changes occur, the updated Terms will be posted on the SafeScripts website with a revised effective date.

Continued use of the Platform after changes are posted constitutes acceptance of the updated Terms.

These Terms shall be governed by the laws of:
– the Province of Ontario
– the laws of Canada

Any disputes arising from these Terms shall be resolved within the jurisdiction of Ontario courts.
